The Terms of Service ("Terms"), is a legally binding agreement between you, as a user, and Clubsum, Inc., operating as Bundli ("Bundli," "we," "us," or "our"). These Terms govern your access to and use of our service, which includes our websites, mobile applications, content, and all related services, features, and transactions (collectively, the "Services").
By accessing or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. You also confirm that you are at least 18 years old and legally able to enter into this agreement. If you do not agree, please immediately stop accessing our Services.
We may change these Terms from time to time. We will make the revised Terms accessible through the Services so you should review it periodically. If you have an account with us, we will inform you of material changes by email as well.
Bundli is a platform that offers a bundle of applications and functionalities for a single membership fee. These Terms govern your use of our Services.
You acknowledge and agree that Bundli is not liable for any direct, indirect, incidental, or consequential damages arising from your use of the service.
Our Services are provided to you solely for your personal, non-commercial use. You may not use the Services for any commercial purpose, such as, but not limited to, competitive analysis, or content resale.
We may, at our sole discretion, change the composition of functionalities and applications, add or remove features from the Bundli Service, or discontinue the service entirely at any time.
To use our Services, you must create a user account ("Account"). You agree to provide us with accurate, complete, and current registration information and to keep it updated. You are responsible for all activities that occur under your Account and for safeguarding your password. You must notify us immediately of any unauthorized use of your Account.
We reserve the right to immediately suspend or terminate your access to the Bundli Service or any part thereof, without prior notice and without liability to you or any third party, if we believe, in our sole discretion, that you have violated these Terms. This includes, without limitation, a belief that you have engaged in fraudulent, inappropriate, or illegal activities, or have otherwise breached these Terms.
Our Services are not intended for or directed at persons under the age of 18. If you are under 18, you may not use our Services. By accessing or using our Services, you represent and warrant that you are 18 years of age or older. We reserve the right to terminate your account if we discover that you have misrepresented your age.
(a) Free Trial: We may offer a free trial period for our Service. To begin a free trial, you may be required to provide your payment information. By starting your free trial and providing your payment information, you explicitly agree that your membership will automatically convert to a paid membership at the end of the trial period and you will be charged the applicable membership fee. You can cancel your free trial at any time before the trial period ends to avoid any charges.
(b) Membership Terms: Our Services are available through a membership plan. By purchasing a membership, you agree to pay the recurring fees associated with your chosen plan. All payments are handled by a third-party payment processor, and you agree to their terms and conditions.
(c) Automatic Renewal: Your membership will automatically renew at the end of each billing cycle unless you cancel it before the renewal date. By providing your payment information, you authorize us to charge the membership fee and any applicable taxes to your payment method at the start of each renewal period.
(d) Price Changes: We may change our membership prices at any time. Any price increase will be effective at the start of your next billing period, and we will notify you in advance. Your continued use of our Services after a price change constitutes your acceptance of the new price.
(e) Cancellation Policy: You can cancel your membership at any time through your Account settings. Your access to our Services will continue until the end of the current billing period, and your membership will not renew. We do not offer refunds or credits for any unused portion of a membership term.
Your data and personal information is governed by our Privacy Policy.
Our Services, including all of its websites, applications, content, design, logos, text, graphics, and underlying software, are the sole property of Clubsum, Inc. and is protected by intellectual property laws. You are granted a limited, revocable, non-exclusive, non-transferable license to access and use our Services for your personal, non-commercial use. This license does not grant you the right to reproduce, modify, or distribute any part of our Services without our express written permission.
You agree to use our Services only for lawful purposes and in strict accordance with these Terms. You are prohibited from:

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BUNDLI, ITS AFFILIATES, OR THEIR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE OUR SERVICES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.
You agree to indemnify and hold harmless Bundli, its affiliates, and their directors, employees, and agents from any claims, damages, liabilities, and expenses (including legal fees) arising from your use of our Services or your breach of these Terms.
(a) Informal Dispute Resolution: You and Bundli agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms through informal negotiation for a period of at least thirty (30) days from the date of a written notice of dispute.
(b) Arbitration: If a dispute cannot be resolved through informal negotiation, you and Bundli agree that it will be resolved by binding arbitration in Delaware, administered by an arbitrator of Bundli's choosing. The arbitration will be conducted on an individual basis; class actions are not permitted.
No waiver by Bundli of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure of Bundli to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
